Instrument (NI) 43-101
Standards of Disclosure for Mineral Projects
National
Instrument (NI) 43-101 is a direct result of a series
of mineral exploration frauds perpetrated on the public
in the late 1990's. During that period certain companies
and individuals disclosed fraudulent, inaccurate, misleading
and/or incomplete information upon which the investing
public relied. The results included massive losses, lawsuits
and a rapid contraction of the Canadian equity markets.
Federal
and provincial regulatory agencies in Canada determined
that a national standard must by put into place for technical
data presented by public companies operating on Canadian
stock exchanges. On February 1, 2001, NI43-101 went into
effect for all corporations listed on public exchanges
in Canada. The purpose of NI43-101 is to force all public-listed
companies to submit geological reports, whether oral or
written, in a standard format. NI43-101 also dictates
certain standards of technical competence along with full
and complete presentation of technical data.
The
author of any report which is intended to qualify for
NI43-101 standards must be an engineer or geoscientist
with at least 5 years experience, must have knowledge
or experience relevant to the subject matter and must
be a member in good standing of a self-regulating professional
association. Such a person, known as the Qualified Person,
must warrant the accuracy and completeness of such reports
and retains professional responsibility for the contents
of the report.
